My husband and I recently contracted with ECUAmerican moving company to move our household goods estimated at 3400 lbs from Austin, TX to Raleigh, NC for $1495. First on the day of the pick up 7/27/07 we were asked to pay $749 of the agreed amount in cash, when on the website they say they accept all forms of payment. When we asked them the purpose they blantly stated “to pay our movers”. We did not pay in cash. Secondly on 7/30/07 we were contacted again by the moving company saying that we exceeded our weight by 2300 lbs. We know this to be untrue because my husband and I just got out of the service and our last move was on 3/15/07 and the total weight was 3200 lbs. We have spoken with the owner, and he refused to even consider that they might be in error when we have an identical inventory list only 4 months prior with the catscale weight. We suggested a re-weigh and the owner insist that it will be at our expense to include labor and truck rental. I have filed a complaint w/ BBB.

You have taken the right steps in protecting yourself, now the next step is to consult an attorney.
The Attorney General in NC , frowns HEAVILY on intertate fraud, so I’d suggest getting the state office involved as well.
By the way…. welcome to NC… we are a friendly folk…:O)..

i like all of the answers — remember to play up the military angle unlike the last war right not for the time being vets are welcome and nc is big military state. the news angle is great.
add info the reason they wanted cash is movers hire day laborers to load and unload and all of the money is payed under the table.. have this enter in to the news cast if possible. good luck — hate to see fellow vets hassled.

The BBB was a good step. If you don’t get any help from the, you could try recruiting the help of some local TV news stations in your area. Many news stations have consumer watchdog groups that help consumers get justice in these situations.
Search Google for “on your side news teams” and the city you are from.

refuse to pay anything additional, and let them sue you for any amount they claim you owe them. File a counter-suit, alleging intentional infliction of emotional distress, trespass to chattel, and fraud. Let the judge sort it out.
